BuzzBytes Srinagar 29 December:
In a landmark decision welcomed by the Kashmir Lawyers Federation, the outdated British Era laws governing the Indian legal system have been repealed and replaced by modern statutes. In a meeting presided over by President Adv. Mudasir Ahmad, the General Body of the Kashmir Lawyers Federation passed a resolution expressing appreciation for the introduction of Bharatiya Nyaya Sanhita (B.N.S), Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Act of 2023.
The members of the Federation underscored that the British Era laws were originally designed to serve the imperialist agenda of the British Raj. The replacement of these laws is seen as a crucial step taken by the current Government to modernize the legal system and align it with contemporary needs.
The new statutes bring forth contemporary provisions, addressing pressing issues such as environmental protection, penalizing human trafficking, repealing sedation laws, modifying evidence-related legislation, ensuring timely disposal of criminal cases, and enhancing the overall efficiency of the criminal justice system. The move has been hailed as a significant stride towards simplifying laws and safeguarding the rights of the people.
While commending the government’s initiative in modernizing the legal framework, the Kashmir Lawyers Federation expressed hope for continued efforts to modernize the judicial system. Members anticipate the introduction of new mechanisms that will enhance the accountability of the judicial system in fulfilling its duties.
This transformative overhaul signifies a positive shift towards a more responsive and contemporary legal framework, ensuring justice that aligns with the evolving needs of society. The Kashmir Lawyers Federation looks forward to further advancements in the modernization of the judicial system for the benefit of the people.
