J&K Special Tribunal Empowered as Appellate Authority for Real Estate Appeals

Jammu, Dec 31: In a significant move, the Union Territory of Jammu and Kashmir designates the J&K Special Tribunal to function as the Appellate Authority, providing citizens with a platform to appeal decisions made by the Real Estate Regulatory Authority (RERA). This temporary measure ensures a streamlined process for addressing grievances until the establishment of a regular Tribunal in accordance with the Real Estate (Regulation and Development) Act, 2016.

The decision, as outlined in a notification by Prashant Goyal, Principal Secretary to the Government, Housing and Urban Development Department, allows the J&K Special Tribunal to hear appeals related to RERA decisions and orders. Individuals aggrieved by the Authority’s decisions or those of the Adjudicating Officer can now seek recourse through the Appellate Tribunal.

The Appellate Tribunal is granted powers equivalent to those of a civil court under the Code of Civil Procedure, 1908, enabling it to summon individuals, enforce attendance, examine witnesses, and more. All proceedings before the Appellate Tribunal are deemed judicial proceedings, underscoring their legal significance.

Notably, this temporary arrangement is the second in the context of the Real Estate (Regulation and Development) Act, 2016, highlighting the continued absence of a permanent Chairperson for the Real Estate Regulatory Authority. Currently, the Principal Secretary to the Government, Housing and Urban Development Department, assumes the responsibilities of the Chairperson. (By Daily Excelsior)
